Is Samsung Really Infringing on Apple Design?

Court has ruled against Samsung, and found them at fault of replicating the Apple iPhone design. But do you know, people also think that Apple has created winning gadgets based on various other companies’ ideas. Therefore, we’re still waiting for the end-result of patent war between the tech-giants.

Federal jury members addressed reporters with a statement where they have asked businesses to refrain from replicating features and designs of others by slapping Samsung with a whooping fine of over one billion dollars for patent infringements. We think that’s commendable step towards innovation and patent protection, since this would encourage companies to bring variety of products in the market. Though, the test would be of differentiating between innovation and imitation.

It’s worth noting that Apple has designed engaging devices based on ideas initiated by various other companies. Take for example; Nokia’s smartphone was introduced as an iPhone with appreciably better features after years. We would also like you to note the fact that good patent policy will help in healthy innovation, whereas the bad policy will only create ruckus and patent infringement assertions.

Design areas of Apple products are quite prone to infringements since most are related to the appearance and experience. Keep in mind that decorative designs are eligible for patent, however functional ones aren’t. For example, take a look at the picture above and differentiate if possible.

You can also supply enough resources along with your application to the U.S. Patent & Trademark Office or USPTO and protect your copy from being labeled as vague and baseless patent.

U.S. Congress introduced patent reform law last year which is being seen as an important step in the process, however court decides on all the infringement claims and verdict of Apple Vs Samsung case is bound to bring more such claims to public interest. We hope, leading companies do not start taking each other to the court of law looking at Apple’s win, which might in turn slow down the product development pace in tech sector.
